(Note: this is a version of our Stud Contract designed for our website and serves as a sample. We reserve the right to modify it as we deem necessary. In the event of differences with in the terms of the contract actually provided to those using our stud services, the actal written and signed copy will prevail in all respects.) KELLYN’S CHAMPAGNE TASTE, Registration No. SM862772/02 Dates bred:________________________________________________________ Estimated date due to whelp:__________________________________________ Stud Fee: ________ Received payment____________________________________ Conditions of Service (and a part of this guarantee): No fee shall be refunded in whole or in part. A guarantee of actual mating (and “tie”) or artificial insemination (AI) only is made and not of pregnancy or of puppies living or dead. If the bitch fails to be in whelp, the owner must give notice to me not later that fifty days after date of first mating or AI. A return service will be given to the same stud without charge, at the next heat (and only this next heat). If there is no pregnancy, owner of bitch to pay all express and shipping charges both ways to accomplish the return service. Unless such notice is given, the right to a return service is forfeited. If my stud dies, is sold, or otherwise not available, I have the right to mate the bitch with one of my other studs if one is available. If bitch changes ownership, right of full return service is at my option and is not transferable. In order to assure myself of the pregnancy condition of the bitch, the right to see and examine her is granted. Two puppies living at birth constitute a litter for purposes of the return service. If the litter consists of more than two puppies, the balance of which are stillborn or do not survive to eight weeks, a repeat service is at my option. If same condition occurs at second whelping, obligations of both parties are terminated. It is specifically understood hereby that the owner of the stud is not obligated to sign application for registration of this litter until and unless the Stud Fee has been paid in full.
